for Trade Secret Case

The need

Attorneys representing a company in its case against a former employee needed an expert in establishing damages in trade secret cases to prove their case. The case alleged that a former employee took documents containing trade secrets to give to competitors, but the plaintiff stopped her before she was able to do so and set up her own business. As such, they were looking for an expert who could testify regarding the value of a company maintaining trade secrets.

Our approach

From conversations with the client, we understood that the case also dealt with the EB-5 visa which allows foreign nationals to make an investment in a business to obtain a green card. Therefore, the ideal expert would need knowledge of this type of immigration. Additionally, we knew discovery deadlines were fast approaching so we quickly went to work to find the best expert for the case.

The expert

We found an expert with over 15 years of experience in providing economic consulting services and serving as a damages expert. The founder and head of his own consulting firm, he had extensive experience conducting business valuations, economic and quantitative analyses, and preparing expert testimony. Additionally, he had served as a damages expert on a wide range of cases including several trade secrets cases and labor disputes. He also had a basic understanding of the EB-5 Immigrant Investor Program. Well-respected in his field, he had been the Regional Commissioner of the Bureau of Labor Statistics, was a member of the National Association of Certified Valuation Analysts and had been a Professor of Economics at two prominent universities. Finally, he had served as an expert witness in over 60 cases, had been deposed over 50 times and had testified at trial in over 20 cases.
