Gastroenterology Expert

for Patent Infringement

The need

Attorneys defending a global generic pharmaceutical company against a patent infringement suit brought by a specialty pharmaceutical company needed an expert in gastroenterology to make their case. The patents-in-suit dealt with a treatment for ulcerative colitis. As such, the ideal expert would need to be a physician with experience diagnosing, treating and/or prescribing medication to treat patients suffering from ulcerative colitis.

Our approach

From conversations with the client, we understood that this expert was critical to get right as they already had to replace an expert on the case. Additionally, they needed someone with experience in cross examination. Knowing this, we went to work to find the best fit.

The expert

We found an expert who was a professor of clinical medicine in the digestive diseases department of a top medical school who had over 30 years of experience treating patients with various stages of ulcerative colitis. In addition to being a professor, he also was the Medical Director of Gastroenterology at a well-respected hospital. A leader in his field, he was an editorial board member of the Journal of Inflammatory Bowel Diseases, had held several fellowships focused on Gastroenterology, and was a Fellow of the American College of Gastroenterology and the American Gastroenterology Association. Additionally, he had worked on clinical development of drugs used for gastroenterological diseases as a Medical Director. Finally, he had served as an expert witness in several patent cases, over 15 medical malpractice cases and had been deposed and testified.
