The need

Attorneys representing a physician in his patent infringement suit against a medical imaging products company needed an expert in radiology to make their case. The patents-in-suit related to disposable markers that are used to help identify problem areas when taking x-rays. They had been invented by the doctor to help with surgery, but then became widely used in radiology with the defendant being a manufacturer of them.

Our approach

From conversations with the client, we understood that the ideal expert must be a radiologist that had worked with radiopaque markers in mammography and could either be a researcher or practitioner. Additionally, the expert had to be in the same area as the case and it was preferred the expert be a woman. The case was on the fast track, so we went to work quickly to find the ideal fit.

The expert

We found an expert who was a professor of radiology and obstetrics at a top university. In her time as a professor, she had developed many radiology educational resources and had participated in the development of the national curriculum for radiology. Active in the radiology publishing community, she had edited for the American Board of Radiology, and co-edited handbooks used widely for radiology. In addition to being a prominent educator she had been a practicing radiologist for many years and her clinical interests included women’s imaging. Well-respected in her field, she was a member of the Alliance of Medical Student Educators in Radiology and the Alliance of Clinician Educators in Radiology, had served as President of both organizations and received several awards from them. Finally, she lived and worked in a location near the case.
